Supreme Court Declines To Overturn Texas Abortion Law

This has been difficult to process.

What is this about abortion being banned in Texas?

When I first heard the news, I thought to myself … surely, there will be a media firestorm and the Supreme Court will strike this down before I can write about it. The True Cons on the Supreme Court will come up with some convoluted rationale for why there is nothing that they can do and the Constitution says that abortion is the law of the land and will issue an opinion that sustains the status quo.

This isn’t happening because Notorious RBG croaked on the eve of the 2020 election and Trump succeeded in getting Amy Coney Barrett on the Supreme Court who appears to have delivered a victory for the pro-life movement. This Texas law essentially bans the vast majority of abortions in the state.

New York Times:

“The Supreme Court on Wednesday refused to block a Texas law prohibiting most abortions after about six weeks of pregnancy. The move, a response to an emergency application from abortion providers in the state, came less than a day after the law became effective, severely restricting access to the procedure.

The vote was 5 to 4, with Chief Justice John G. Roberts Jr. joining the court’s three liberal members in dissent.

The majority opinion was brief and unsigned, and it said the providers had not made out their case in the face of “complex and novel” procedural questions.

“In reaching this conclusion,” the opinion said, “we stress that we do not purport to resolve definitively any jurisdictional or substantive claim in the applicants’ lawsuit. In particular, this order is not based on any conclusion about the constitutionality of Texas’ law, and in no way limits other procedurally proper challenges to the Texas law, including in Texas state courts.”

In dissent, Chief Justice Roberts wrote that he would have blocked the law while appeals moved forward.

“The statutory scheme before the court is not only unusual, but unprecedented,” the chief justice wrote. “The legislature has imposed a prohibition on abortions after roughly six weeks, and then essentially delegated enforcement of that prohibition to the populace at large. The desired consequence appears to be to insulate the state from responsibility for implementing and enforcing the regulatory regime.” …”

John Roberts, of course, sided with the progressives.

“In its next term, which starts in October, the Supreme Court is set to decide whether Roe v. Wade should be overruled in a case from Mississippi concerning a state law banning most abortions after 15 weeks that has been blocked by the courts. …”

Apparently, this decision doesn’t uphold the constitutionality of the Texas law, which is still in legal limbo and could still be challenged and overturned. It might only be a temporary victory. The real test is coming up in the Supreme Court’s next term in which Roe itself could be overturned. The Supreme Court’s ruling on the Mississippi law will be a defining moment for the conservative legal movement.

  1. Every now and then they throw “conservatives” a bone to convince them that the “system” is working. Don’t hold your breath waiting for the supremes to overturn forced integration, aka “civil rights”.

      Abortion is more a moral question rather than a ‘liberal’ vs ‘conservative’ political issue — there is no shortage of pro-choice ‘conservatives’ — while for most of my life I was agnostic about it (i.e. I accepted the Roe v Wade status quo), I always plainly conceded the moral high ground to the pro-life side.

  3. Isn’t Texas minority white? So……….the Right is happy that more browns, blacks and unwanted babies will be born are they? If trailor trash parents don’t want children and won’t give them a stable upbringing, isn’t it better just to NOT have them in society?
    Strategy and logic is lacking here.

    • The problem of hordes of colored people in the U.S. can only be solved through mass deportations, not abortions. Fortunately, Mexico and other benighted countries that are the source of most of these squat monsters are due south and they can be sent back to where they came from without too much logistical difficulty. It’s our misfortune to share a 2,000 mile border with that region of the world.

      All that is needed is the political will and that won’t make an appearance until the U.S. is in a complete shambles after a series of catastrophes that wrecks everything thus discrediting the ruling class. We are many miles from there now. The rest of the colored hordes need to go too but their logistics are more difficult.

      U.S. defeat regarding Taiwan and a subsequent crash in the U.S. dollar with resulting high inflation will cause chaos. This will reveal once again the venal nature of the U.S. political system and the gross incompetence and corruption of the ruling class. Until the ruling class is thoroughly discredited after wrecking the country nothing gets fixed. They are like blood sucking ticks, deeply imbedded and sucking every last ounce of the country’s life blood for their own benefit.

      Voting, democracy, elections, constitutions, supreme courts, political parties are all shit, they can’t save the country from the coming disasters.

A concertina wire fence 20 feet tall, 20 yards deep, multiple rolls of wire tied together from Brownsville, Texas to San Ysidro, Cal. could be laid down starting today with what’s in DoD inventory. There are plenty of troops able to do the work. The fence could be completed in a few weeks, every inch of it.

          It would be 99.99% effective, that’s why the U.S. Government never constructed such a fence. The Government does not want to secure the border for a variety of reasons even though that policy is destroying the country.

          The great tragedy is that Idiot Trump could have completed such a fence with Executive Orders. As Commander in Chief of the military with a clearly defined responsibility for protecting the country from invasion, this was his duty. If he had an ounce of moral courage he would have secured the southern border.

    • The blacks and browns who want babies are already popping them out. Abortion is a moral issue, and the evil practice is rightly seen as a form of satanic human sacrifice.

    One could just as easily put the decision down to laziness, as with declining to consider 2020 election issues.

    Right, another big win for Blumpf — she sided with the lazy majority in declining to consider the Texas 2020 election case — search up the video of her confirmation hearing where, in a bizarre bit of pubic performance (or conformance) art, she claims to have cried with her adopted black daughter (barf, as if that’s not all you need to know about her) after hearing the news of George Floyd’s death — the woman is a disgusting phony, not to mention a teller of convenient, politically correct lies.

    A 70 y/o white woman named Yvonne Ruzich was brutally shot to death not long ago in Chicago by two teens™ during a carjacking — Amy Coney Barrett won’t be shedding any tears for her — she saves those for drug addicted Blacks who lead lives of crime and menial employment.

    • Amy Coney Barrett is insane. After having her own family she decides to start another fambly by acquiring some sullen negro children who will be nothing but trouble. As a judge she must have seen negroes/hispanics day in, day out committing viscous crimes constantly yet she still decides to acquire a few of them? WTF was she thinking?

      If she were not a judge she would probably be a crazy cat lady with a house filled with cats, never enough though.
